PURCHASER agrees that if ARTIST, at ARTISTS sole discretion, decides that an encore is warranted and desirable, PURCHASER including PURCHASER and security personnel, shall in no way allow the audience to be given the impression that an encore is not forthcoming, nor in any way interfere with the performance of said encore. Further, PURCHASER shall specifically instruct the facility manager to keep the facility's house lights off until it has been positively determined whether or not ARTIST will perform an encore number.
4. Support Acts
ARTIST shall have the right of approval of any and all acts on the show, including but not limited to length of show by any such opening act.
5. Percentage Compensation
In cases where the ARTIST is being paid on a percentage basis, PURCHASER agrees to deliver to the ARTIST c/o Khanextions, LLC, 9100 Wilshire Boulevard, Suite 515 East Tower, Beverly Hills, CA 90212 at least two (2) weeks prior to the date of performance, a plot plan and printer's manifest of the house seating for the event in question plus a notarized, signed statement from the printer of the tickets, listing amount of tickets printed at each price.
PURCHASER further agrees to have on hand at place of performance the night of the show all unsold tickets, (including unused complimentary tickets) to be counted and verified by agent of ARTIST. ARTIST shall be compensated for the difference between the number of unsold tickets on hand and the number of tickets printed as shown by the printer's manifest. If the PURCHASER violates any of the preceding provision, it shall be deemed that PURCHASER has sold a seat in the house (and any permitted standing room), at the highest price for which the house is scaled.
6. Box Office Rights
When ARTIST is headlining and/or is being paid on a percentage basis, PURCHASER further agrees to ARTIST'S representative (s) right to enter the box office at any time (before, during and after performance), to examine and make extracts from box office records of PURCHASER relating to the gross receipts for the engagement. A written box office statement, certified and signed by the PURCHASER shall be furnished to the ARTIST'S representative (s) prior to the intermission of the show.
