16. Merchandising

A) PURCHASER agrees that the ARTIST'S merchandiser shall have the sole and exclusive rights to sell all non-beverage items at or about the venue on the day of the ARTIST'S performance, including but not limited to souvenir books, photographs, recordings, wearing apparel, posters, stickers, programs and other items of merchandise prior to, during and after each performance, whether or not such items bear ARTIST'S name and/or likeness.

 

B) PURCHASER shall provide well lit, prominently placed, adequate space, tables and securityfor merchandiser to vend such material, and PURCHASER agrees that ARTIST'S merchandiser shall, as it may require, have access to any and all hall facilities and any and all adjacent to the venue.

 

C) PURCHASER further agrees to use its best efforts to prevent and stop the sale or distribution by any person other than ARTIST'S merchandiser, whether inside or outside the venue, of any merchandise at the engagement at which ARTIST performs. It is understood that no person or entity other than ARTIST'S merchandiser shall have the right to sell at the engagement without the express written consent of ARTIST or its merchandising company.

 

 

17. Security

PURCHASER shall gurantee proper security at all times to insure the safety of ARTIST, ARTIST'S instruments and personal property before, during and after each rehearsal and performance, as well as securing areas of the dressing rooms, stage areas and all exits and entrances to thefacility. Security protection shall commence upon arrival of ARTIST'S equipment at the venue or as directed by the ARTIST'S security chief.

PURCHASER to provide ample security as directed by ARTIST'S Security Chief in the on-stagearea to keep persons not directly connected with the performance clear of the stage area and backstage area. NO ONE other than those designated by ARTIST'S Security Chief shall have access to on-stage or backstage area at anytime. IF SECURITY MEASURES ARE NOT ACCEPTABLE WITH THE ARITST'S SECURITY CHIEF, PURCHASER SHALL MAKE ARRANGEMENTSFOR MORE SECURITY. These services shall be at no expense to the ARTIST.

 

ARTIST'S and their personnel will have in their possession an "ALL ACCESS" ARTIST'S tour ID pass. ARTIST'S Tour Manager will issue these passes on the day of the performance to PURCHASER and stage crew. NOTE: NO OTHER TYPE OF PASS WILL BE HONORED THE ENTIRE DAY. ARTIST'S SECURITY CHIEF SHALL HAVE ABSOLUTE RIGHT OF APPROVAL ON ALL PASSES REQUESTED BY PURCHASER.

 

PURCHASER shall also provide to ARTIST'S Tour Manager will issue these passes on the day of engagement a floor plan of the venue and the name and phone number (s) of building manager. In addition, PURCHASER, shall provide the name, phone number and address of, and directions to, the closest hospital to the venue.
