9. The Writer hereby consents that this contract and all copyrights and other rights hereunder may be assigned by the Publisher either expressly or by operation of law subject, however, to the payment of royalties heretofore provided.

 

10. In the event that the Writer shall become mentally or physically incapacitated so that he is unable to, or in the event that he shall fail, refuse or neglect to carry out the provisions of this agreement upon his part to be performed, then in any such event the Publisher shall be relieved of any obligation to make further royalty advances pursuant to this agreement. The publisher shall also be entitled to extend the term of this agreement during the period of such event.

 

11. The Writer hereby warrants and represents that he is under no legal restriction against entering into this agreement.

 

12. The Writer hereby agrees that during the term of this agreement, and any extension thereof, he shall obtain the Publisher's approval of any person with whom he shall collaborate.

 

13. All payments and notices hereunder shall be made to the Writer at the address of __________ unless otherwise directed in writing.

 

14. The term "Publisher" as used throughout this agreement shall be deemed to apply to the Publisher and its designees, successors and assigns.

 

15. This agreement shall be binding upon and shall ensure to the benefit of the Publisher and its designees, successors and assigns, and the Writer and Writer's personal representatives and assigns.

 

IN WITNESS WHEREOF, the Writer and the Publisher have caused these presents to be executed as of the day and year first above written.
