10. Cancellations And Artistic Control Performance

A) If ARTIST'S obligations hereunder are subject to prevention or detention, delay, impossibility or impracticability, by reason of sickness, inability to perform, accident, failure of transportation, an act of public authority, immigrant of labor union restrictions and/or any other cause similar or dissimilar, beyond ARTIST'S control. ARTIST shall not be required to perform the scheduled engagement. In the event that the ARTIST'S shall for any reason set forth in this paragraph, not perform the engagement any wages or fees hereto paid by PURCHASER or ARTIST for the engagement, shall be returned to the PURCHASER and neither PURCHASER or ARTIST shall have any further obligations or liability to the other regarding the engagement. In the case of a scheduled rain date, this will be negotiated apart from this Rider before the date of engagement between the PURCHASER and the booking agent.

 

B) ARTIST has 100% artistic control of the performance with regard to sound, lighting material, wardrobe, staging, etc., but will, of course take into consideration local curfew and sound by laws. ARTIST shall have priority in set-up, rehearsal and position of equipment. Equipment and accessories shall not be moved, disconnected or used without the express consent of ARTIST'S Technical or Production Manager. ARTIST must be guaranteed two (2) hours for sound check prior to doors opening and shall have the right to hold the doors fifteen (15) minutes past opening, scheduled time.

 

C) ARTIST shall have the right to cancel this engagement without liability upon written notice to PURCHASER not later than thirty (30) days prior to the date of the engagement in the event that there has been secured for ARTIST a conflicting commitment.

 

D) In the event of outdoor engagements, PURCHASER shall provide a covered stage. Should inclement weather (rain, cold, etc.) create unsafe and/or unhealthful conditions for the ARTIST. ARTIST reserves the right to make a final decision as whether show will begin and/or continue without limiting any of their rights contained herein including but not limited to the ARTIST's fee for this engagement.

 

E) Artist shall have the right to cancel this engagement without liability to PURCHASER in theevent that the equipment and/or facilities are inferior or insufficient and compromises the integrity of the ARTIST'S performance hereunder.
