7. Ticket Sales

PURCHASER may not sell tickets to the performance as part of series of other concerts, without the written permission of ARTIST. All tickets printed under the manifest shall be of one stub, one price variety. There shall be no multiple price tickets printed. Examples of tickets prohibited under this agreement are:

 

A) One price for students and another for general admission on the same ticket.

 

B) One price for tickets bought in advance, and a different price for teckets bought at the gate on the same day on the same ticket.

 

C) There shall be no roll tickets of any kind.

 

D) Further, no tickets can be sold for seats located to the rear of the stage, where the stage and equipment on stage is obstructing normal eye level viewing of the ARTIST'S performance, unless the location of the seat is clearly indicated on the face of the ticket. For temporary theater-in-the-round engagement, tickets sold for seats behind the stage must be marked, "Obstructed vision" or "Behind Stage". Theater-in-the-round in this instance means coliseum type seating.

 

E) Tickets sold for radio, press, TV, record company personnel, PURCHASER or any other party shall be negotiated through the PURCHASER and respective parties and shall in no way affect the ARTIST'S guaranteed compensation or receipts in a percentage situation.

 

F) Seats blocked by sound and light mixing consoles shall not be charged to the ARTIST and shall in no way affect the ARTIST'S guranteed compensation or receipts in a percentage situation.

 

G) ARTIST will not perform at a theater-in-the-round unless so specified on the face of the attached contract.

 

H) The specific capacity, gross potential and ticket price breakdown of the facility where the ARTIST is to perform under this agreement must be clearly printed on the face of the attached contract.

 

I) If PURCHASER violates the above agreement (7A-H), he shall be liable for the total amount of tickets sold at the highest price printed on the tickets. All tickets shall be printed by a bonded printing house such as Globe tickets, Arcus-Simplex, Ticket Master, Computicket. If the performance is at a college or university, the official printing department of the institution may be used. PURCHASER agrees not to discount tickets or to offer tickets as a premium without first obtaining permission in writing from the ARTIST. If PURCHASER does sell or distribute discount or complimentary tickets without prior approval or in excess of the number printed, he shall be liable for the full ticket price of each ticket sold or distributed.

 

 

8. Complimentary Tickets

A) PURCHASER agrees to distribute fifty (50) complimentary tickets to the ARTIST for each engagement under this agreement. The said tickets shall be good for the highest priced tickets, well placed, in the first (10) rows (ARTIST runs special events through fanclub). ARTIST'S representative will supply PURCHASER with a guest list prior to the show. Guest tickets shall be at the box office at the time that the doors to the facility are open to the public. Members of ARTIST Management, shall not be counted in the total of fifty (50) complimentary tickets. In most cases, ARTIST MANAGEMENT will use standing room only.

 

B) PURCHASER agrees to distribute no more than 5% of the official house seating as complimentary tickets relative to this performance. This is in respect to tickets for T.V., radio, record company personnel, etc. The fifty (50) comlimentary tickets due the ARTIST shall not be part of the 5%. Further, PURCHASER must supply the representative of the ARTIST with a statement detailing to whom each complimentary ticket was given. Unused complimentary tickets may be put on sale at the discretion of the facility manager and the ARTIST'S representative. If the tickets are not picked up by thirty-five (35) minutes after ARTIST has begun the show, they maybe put on sale.
